1. Parties.
rahsyland.net is a Domain, Email & Hosting Service Provider and a party to this Agreement.
The person who enters into contract with rahsyland.net (herein referred to as "you")
is the other party to this Agreement.
2. Agreement: Change in Terms.
By accessing rahsyland.net services, you agree to be bound by the terms of this Agreement.
You also agree to be bound by any change in these terms which may be published via rahsyland.net
services while you are a user of rahsyland.net services. If you do not want to be bound by the
terms of this Agreement or by any subsequent changes to these terms, please contact rahsyland.net
immediately so that we may close your account.
3. Limitation of Liability and Indemnity.
You agree that rahsyland.net will not be liable to you, beyond the refund of your current term's
charges, for any direct, indirect, consequential, special or punitive damage(s) or loss(es)
whatsoever you may incur in connection with the use of the rahsyland.net system or any of the
data or other material transmitted through or residing on the rahsyland.net system, even if
rahsyland.net has been advised of the possibility of such damage or loss. This includes, but is
not limited to, loss of data or any other loss whatsoever resulting from delays, nondeliveries,
misdeliveries, or service interruptions of any nature whatsoever. In addition, you agree to
defend and indemnify rahsyland.net and hold rahsyland.net harmless from and against any and all
claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable
attorneys fees) relating to any acts by you or materials or information transmitted by you or
any use by you of rahsyland.net services which leads wholly or partially to claims against
rahsyland.net or the rahsyland.net system by you, by another customer or by any other person or
entity. Without limiting the generality of the above paragraph, you further acknowledge and agree
that: a. No Warranties: No Responsibility. rahsyland.net exercises no control whatsoever over
the content of the information passing through its Internet connection. rahsyland.net makes no
warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content
of the information, products, or services is is providing. rahsyland.net disclaims any warranty of
merchantability or fitness for any particular purpose. Use of any information or data obtained via
rahsyland.net is at your own risk. rahsyland.net bears no responsibility for the accuracy or
quality of information obtained through its services.
Further Agreements
You further acknowledge and agree:
4. Use Restricted to Lawful Purposes.
You agree that you will only use rahsyland.net services for lawful purposes. You agree that you
will not transmit any material in violation of any U.S. federal, U.S. State, or foreign law.
This includes, but is not limited to copyrighted material, material legally judged to be
threatening, obscene, in violation of the Communications Decency Act or any other section of the
Telecommunications Reform Act of 1996, or material protected by trade secret. Your keyboard input
or files may be monitored in the event of a real or perceived security incident. You agree that
rahsyland.net may remove objectionable materials residing on the rahsyland.net servers. Such removal
shall be at rahsyland.net's sole discretion and rahsyland.net shall be the sole judge of what
constitutes objectionable material.
5. Other Networks: Access and Cancellation at rahsyland.net Discretion.
You agree to comply with the acceptable use policies, rules and regulations, and terms and
conditions of any networks accessed by you through rahsyland.net. rahsyland.net reserves the
right to refuse service to anyone. rahsyland.net further reserves the right to deny access to,
or close, any account(s) which, in rahsyland.net's sole opinion, is (are) causing, or may cause,
harm to the rahsyland.net server or to to other systems. rahsyland.net will make reasonable effort
to notify any user of rahsyland.net action, but is not bound by this agreement to do so.
6. Disk Usage.
You agree that storage of user data will be done within the user's assigned home directory,
or as assigned by the rahsyland.net staff. You agree not to use other disk space, except for
rahsyland.net system programs making temporary use of the system's public file system areas.
rahsyland.net agrees to supply account users the specified amount of disk space as stated on
the sign up form. Those requiring additional disk space may contact rahsyland.net for details.
7. Mail Usage.
You agree that you will not send bulk mail to more than one hundred (100) users nor unsolicited
commercial mail to multiple recipients or use your rahsyland.net account or web pages as a
return address for unsolicited commercial mail originated elsewhere.
8. System Abuse.
Administrative intervention required due to abuse of any of the policies in the Agreement
will be billed to the user at $100 per hour.
9. Rights not Waived.
Failure by either you or rahsyland.net to insist upon compliance by the other party with the terms
and conditions of this Agreement shall not constitute a waiver of any rights under this Agreement.
10. Partial Invalidity.
If any part, term, or provision of this Agreement is determined to be invalid or unenforceable by a
court, board, or tribunal of competent jurisdiction, such term or provision shall be construed in
all respects as if such provision were written in a manner acceptable to said court, board, or
tribunal, or, if such provision is found to be totally unacceptable to such court, board, or
tribunal in any form, then as if such invalid provision were omitted altogether.
11. Entire Agreement.
It is expressly understood that there are no oral agreements or understandings between you and
rahsyland.net which will be deemed to extend, restrict, or otherwise supersede the exact terms of
this agreement. If any provision of this Agreement fails to comply with applicable law, then this
Agreement shall, without prior notice, be automatically modified to conform with the minimum
requirements of any law or governmental regulation having application to or jurisdiction over the
subject matter or the parties hereto. Otherwise, this Agreement, the Application Form, and any
later written changes published via rahsyland.net service, constitutes the entire agreement between
the parties.
Acceptable Use Policies:
1. If you send spam, your account will be closed. Even if you only send
spam one time, your account will still be closed as soon as we find out you
sent spam. Contrary to what you may have heard, Spam it is not
an effective marketing tool, and no one appreciates it. It is a waste of
our network and system resources, and we are absolutely intolerant of anybody
who sends or attempts to send spam. Your account will be terminated and no
refunding or pro-rating will take place.
2. Pornography, pirated software, mp3 archives, rom archives,
freeware/shareware software archives, cracking/hacking tools, and
spamming are not allowed at rahsyland.net. Any material of this nature or links to
material of this nature will cause the account to be shut without financial
refund. These types of sites waste bandwidth and slow down the servers. It
is not realistic to allow one site to ruin the speed for all of the sites.
Additionally, sites of this nature often place web hosts at legal risk, and
therefore cannot be allowed.
3. Websites that contain material that is intentionally offensive to racial
or religious minorities are not permitted. Sites that are found to contain such offensive
content will be closed.
4. Clients that tax the machine down with malfunctioning cgi scripts will lose
their right to have cgi scripts. Everybody writes a cgi that locks up from time
to time, but rahsyland.net will not allow one client's scripts to ruin the server speed
for the rest of the clients. Keep this policy in mind when uploading cgi
scripts, since you assume full responsibility for every cgi that you upload. If
your cgi is causing a noticable performance bottleneck, your cgi-bin will be
disabled.
5. Accounts that reach 3 months (90 days) past due will automatically have their websites and FTP
accounts disabled. rahsyland.net reserves the right to disable or discard accounts for late payment.
A $20 re-activation fee will be attached to an account that has been disabled for this reason.
This grace period is very liberal and provides plenty of time to send payments. We endeavor to provide
quality service to our paying customers. Thus, rahsyland.net cannot waste time supporting delinquent accounts.
6. Accounts created in the middle of the month get the rest of the month
for free. For example, an account created on January 15 will not owe money
for January. This policy makes sure you get your money's worth.
7. If you delete or overwrite mail or web site content accidentally, or realize you need
it later, rahsyland.net will not restore your content.
8. Pricing and policies are subject to change at any time.

rahsyland.net is not affiliated with any of the sites or companies linked to or from this website.
2. eMail Anti-Virus scanning.
The rahsyland.net mail server attempts to block email containing known viruses from reaching it's destination.
It checks both sent and received email traveling through the mail server. If the virus scanner discovers an email containing
a virus, it will quarantine the infected email and alert both the mail sender and the intended recipient(s) about the infected email.
Virus definitions are automatically updated daily to keep up-to-date when new viruses appear. However,
rahsyland.net can not guarantee that your email will be 100% free from virus infection. No virus protection software is
100% effective. The anti-virus scanning should block the majority of the viruses. In spite of this service it is still a good idea to
maintain a virus protection solution on your own computer(s) and network(s).
